REACH Legislation

The European Union directive REACH (Registration Evaluation andAuthorization of Chemicals) is aimed at protecting human health and environmentfrom the risk of chemicals. REACH came into force in June 2007. REACH attempts to systematically gatherinformation on chemicals, which are in the market, in order to harmonize legislation across the European member states. ECHA is to publish the firstr ecommendation of priority substances to be considered for authorization on June1, 2009.

REACH Process

Several steps need to be undertaken by the industry to comply with the legislation. The first relevant step in the REACH process of pre-registrationhas been completed successfully. The pre-registration of 'phase in substances’has come to an end on December 1st, 2008.

The majority of our products are polymers which are exempt from registration. It is the components of the polymer compounds that had to be (pre)-registered.

We can confirm that Ticona has pre-registered the monomers for all its products manufactured or imported. Also, where necessary, performance additives have been pre-registered. Ticona does not foresee any need to withdraw products from the market because of REACH.

The next step will be preparing for registrationof our high volume substances (monomers) due on November 30th, 2010.

Use and Exposure Data

The minimum requirements for information on exposure are given in the REACH text. We will continue to actively follow the Technical Guidance Document on preparing theChemical Safety Report (CSR) [REACH Implementation Project (RIP) 3.2] developments and prepare for REACH entry into force by collection and assessment of the applicable data. Asreporting requirements and data confidentiality are clarified, Ticona willdevelop the exposure scenarios.

For more information on our position towards and the status of our REACH implementation, please, refer to the attached communication letters. You will also find a statement regarding SVHC in Ticona products (substances of very high concern).

Please, understand that at this stage of the process we are not in a position to make covenants to individual customers.

Sincerely,
Thomas Weller
